Terms of Service
These Terms of Service (“Terms”) govern the provision of coaching services by Dominic Dauria | Simple Soul, LLC (“Coach”) to clients (“Client”). By engaging in these services, the Client agrees to these Terms.
Services
1.1 The Coach provides in-person or virtual coaching sessions as agreed upon in advance. Each session typically lasts one hour and occurs on a weekly or biweekly basis, unless otherwise arranged.Co-Active Collaboration
2.1 Coaching is a collaborative process. The Coach facilitates personal development, while the Client agrees to take necessary actions toward achieving their goals.Coaching vs. Therapy
3.1 Coaching is not a substitute for psychological counseling, therapy, or psychiatric care. Clients are encouraged to disclose any past or current mental health treatments.

4.1 All information shared in coaching sessions will be treated as confidential. However, confidentiality may be broken if required by law or to prevent clear and imminent danger to the Client or others (e.g., cases of abuse or harm).
4.2 The Coach will seek the Client’s consent before sharing any information outside the coaching relationship unless legally mandated.Respecting Boundaries
5.1 The Client may decline to discuss any topic during a session. The Coach will respect this decision.Professional Ethics
6.1 The Coach adheres to the ethical guidelines of the International Coaching Federation (ICF). More information can be found at www.coachfederation.org.Client Responsibilities
7.1 The Client is expected to actively participate, complete agreed-upon tasks or exercises between sessions, and engage openly and honestly.Limitations of Liability
8.1 The Coach does not guarantee any particular outcome or result from coaching services. The Client acknowledges that coaching outcomes depend significantly on their own efforts.
8.2 The Coach is not liable for any direct, indirect, incidental, or consequential damages arising from the coaching relationship. Coaching does not replace legal, financial, medical, or psychological advice, and the Client is responsible for their own decisions and actions.Communication and Availability
9.1 The Coach and Client will agree on preferred communication methods (e.g., phone, video conferencing, email).
9.2 The Coach aims to respond to inquiries within a reasonable timeframe but does not guarantee immediate availability.Intellectual Property
10.1 All materials, tools, and resources provided by the Coach remain the Coach’s intellectual property. The Client agrees not to reproduce, distribute, or share these materials without the Coach’s written consent.Termination of Coaching Relationship
11.1 Either party may terminate the coaching relationship with written notice.
11.2 If the Client is absent for four consecutive weeks without notice, the Coach may consider the agreement terminated.Cancellation Policy
12.1 The Client must provide at least 24 hours’ notice to cancel or reschedule an individual session. A $45 cancellation fee may apply if adequate notice is not provided.
12.2 Packages and programs are not subject to cancellation fees; however, timely notice of rescheduling is appreciated.Refund Policy
13.1 All fees are non-refundable. The Client should consider their decision carefully before making any payments.Client Testimonials
14.1 With the Client’s permission, the Coach may use testimonials for promotional purposes. No personally identifying information will be disclosed without explicit consent.
14.2 The Client may withdraw consent for the use of their testimonial at any time by providing written notice.Data Protection and Privacy
15.1 The Coach is committed to protecting the Client’s personal information in compliance with applicable data protection laws. By using our services, the Client agrees to our Privacy Policy.Modifications to Terms
16.1 The Coach reserves the right to update or modify these Terms at any time. Any changes will be communicated via email or posted on our website. Continued use of services after changes are posted constitutes acceptance of the updated Terms.Governing Law and Jurisdiction
17.1 These Terms are governed by the laws of New York. Any disputes arising under these Terms shall be subject to the jurisdiction of New York courts.Severability
